Do the new automated-decision rules apply to you?

From 10 December 2026, organisations covered by the Privacy Act must explain in their privacy policy the decisions that software makes, or substantially helps make, about people. Answer eight questions to see whether it applies to you and what your policy would need to say.

1. Is your organisation covered by the Privacy Act?

Generally yes if annual turnover is over A$3 million. Health service providers, credit reporting bodies and some others are covered regardless of size.

2. Do you use software for any of these?

Include vendor tools, scoring rules and spreadsheets with formulas, not only AI.

3. Does the software make the decision, or recommend it to a person?
4. How often does a person change what the software suggests?
5. What personal information does it use?
6. Is any of it a vendor’s AI or scoring tool?
7. Does your privacy policy describe automated decisions today?
8. Your industry and team size
